Damage to the vessel

Our vessel on charter arrives at her berth with a piece of metal sticking out under the waterline. The hull of the ship is ripped open, including a bunker tank, thereby damaging the cargo in the hold and causing considerable pollution as a consequence.

Owners are responsible towards the Authorities for the clean-up operation, cargo owners pursue claims against the Owners (under their Bills of Lading) but the Owners seek recovery from Charterers under the terms of the charter party. Of course, the repairs of the ship are part of the overall claim against Charterers since the berth is considered to be unsafe.
