A back-to-back charter party
Charterers fix a vessel-on-time charter on a back-to-back basis. Head-Owners have to settle cargo claims (under the Bills of Lading) which they reported to Charterers for recovery. Since the Time-Charterer fixed on a back-to-back basis, any claims are passed down the charter chain. Unfortunately the sub-Time-Charterers disappear and have gone bankrupt. Any cargo claims therefore remain with the Time-Charterer who thought it had a secure position being “in between” in the chain of contracts.
